MB&FC EVENT PARTICIPATION TERMS AND CONDITIONS

THE FOLLOWING TERMS AND CONDITIONS APPLY TO ALL EVENTS, INCLUDING TOURNAMENTS, ORGANISED OR ADMINISTERED BY THE MATARANGI BOATING AND FISHING CLUB (“the Event/s”)

OVERVIEW

1. There is a certain degree of risk is associated with fishing whether land-based, from personal watercraft or from any sized vessel. Hazards that may be encountered while involved in the Event may include and are not limited to weather conditions, sea conditions, underwater obstructions, channel markers, other vessels, navigating, anchoring, traveling during darkness, mooring, and all other potentially hazardous aspects of the sport of fishing and boating in general.

VESSEL OPERATOR SAFETY CONDITIONS

2. All participants operating a vessel in an Event acknowledge and agree that:

a. They will ensure all passengers on the vessel have been made aware of and agree to the General Event Participation Conditions.

b. They have the necessary skill, knowledge and qualifications to safeguard all on board the vessel.

c. The vessel and all equipment is properly maintained.

d. The vessel carries all the necessary safety equipment.

e. The vessel will have a minimum of two means of communication; i.

e. VHF marine radio, cellphone, flares.

f. They will ensure that all passengers will each have a correctly fitting buoyancy aid and be briefed on the location and use of all safety equipment.

g. The vessel is loaded within its limit and all equipment is securely stowed.

h. Where possible they will attend an Event briefing

i. It is the sole responsibility of the vessel operator to advise his/her passengers of the information given at the Event briefing.

j. It is the sole responsibility of the vessel operator to advise the Event organisers of their intended fishing area and estimated time of return.

k. In the event of an emergency on the water, participants are to notify their nearest Coastguard or radio operator.

GENERAL EVENT PARTICIPATION CONDITIONS

3. All Event participants acknowledge and agree that:

a. all participants must be in appropriate physical condition to participate in the Event, given the known parameters of the Event;

b. there are risks involved in the Event, some of which are described in paragraph 1 above, and participants fully realise the dangers of participating in the Event, and fully assume the risks associated with participation before, during and after the Event;

c. The Event organisers (including all officials and volunteers) provide no warranties, regarding personal wellbeing and personal or property safety;

d. situations may arise during the Event, which may be beyond the immediate control of the Event organisers (including all officials and volunteers);

e. participants will participate in the Event, in a manner that does not endanger themselves or others;

f. neither the Event organisers nor any parties associated with the Event shall have any responsibility, financial or otherwise, for any risk incident that may arise, whether or not by negligence, from any direct or indirect loss, injury or death that might be sustained by participants or their property and equipment or from their intended or actual participation in the Event or related activities;

g. participants will comply with the rules, and regulations pertaining to the Event;

h. participants agree to follow all reasonable safety instructions provided to them by the Event organisers, (including all officials and volunteers) before, during and after the Event;

i. each participant consents to receiving medical treatment in the event of illness or injuries suffered during or immediately after the Event;

j. notwithstanding any representations made, it shall be the responsibility of all participants to ensure compliance with the provisions of all statutes, ordinances, regulations and by-laws related to (but not limited) to boating and fishing;

k. participants have read and understood the Event Rules.

OTHER MATTERS

4. Participants authorise the use of their name, voice, picture and information on this entry form in any broadcast, telecast, promotion, advertising, and in any other way, by the Event organisers without payment or any other form of compensation.

REFUND OF TICKET

5. Your Event ticket will be fully refunded if you do not agree to comply with these conditions and you request refund within 24 hours of the purchase of the ticket and before the commencement of the Event. Your refund request should be made to matarangifishing@gmail.com
